For the purpose of processing messages and requests and honoring them ENERGIE FINANZIERUNG UND KAPITAL SRL collects personal data of customers, namely name, e-mail address and telephone number, in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the European Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data.

We process your name, e-mail address and telephone number, for communication with you to fulfil contractual obligations and to respond to requests/messages sent through the website.

All this data will be kept for the duration of the financial and fiscal record keeping required by the relevant legislation, but not more than 5 years.

We do not use personal data for automated processing or profiling. We never make automated decisions about you. We use technical means to store data securely. We do not process data for secondary purposes incompatible with the purposes for which we collected it.

We strictly respect and ensure the confidentiality of the data processed. We do not disclose data except for the fulfilment of your interests or legal obligations. Confidentiality is a core value for us.

In order to place an order, the customer shall provide the data and information requested in the online form for sending a message, placing an order or by telephone, refusal to provide the requested information will prevent the seller from registering and honoring the order placed.

The customer is obliged to provide correct and true data, bearing full responsibility for the incorrectness of the information provided to the seller.

Your rights

Thus, you have the right to obtain from us, without undue delay, the rectification of inaccurate personal data concerning you. Taking into account the purposes for which the data have been processed, you have the right to obtain the completion of personal data that are incomplete, including by providing an additional statement.

You have the right to obtain from us the deletion of personal data concerning you without undue delay and we are obliged to delete personal data without undue delay if one of the following reasons exists:

• The personal data is no longer necessary for the purposes for which it was collected or processed;
• You withdraw your consent on the basis of which the processing is taking place and there is no other legal basis for the processing;
• You will object to the processing and there are no legitimate grounds for the processing;
• Personal data have been unlawfully processed;
• Personal data must be deleted to comply with a legal obligation incumbent on us under European Union law or Romanian law;

If we disclose your data to courier companies or other partners and you request their deletion, we will take all reasonable steps to inform the partners processing the data that you have requested the deletion of any links to that data or any copies or reproductions of that personal data.

Data will not be deleted if:

• The processing is necessary for compliance with a legal obligation providing for processing under Union law or Romanian law or for the performance of a task carried out in the public interest;
• For reasons of public interest in the field of public health;
• The processing is necessary for the establishment, exercise or defence of legal claims.
• You have the right to have the processing restricted if one of the following applies:
• Challenge the accuracy of the data, for a period that allows us to verify the accuracy of the data processed;
• The processing is unlawful, and you object to the erasure of the personal data and instead request restriction of its use;
• We no longer need the personal data for the purpose of processing, but you will ask us for them for the establishment, exercise or defence of a legal claim.
• Where processing has been restricted in the above cases, such personal data may, with the exception of storage, only be processed with your consent or for the establishment, exercise or defence of legal claims or for the protection of the rights of another natural or legal person or for reasons of substantial public interest of the European Union or the Romanian State.

In case you have obtained the restriction of the processing of personal data, you will be informed by us before the restriction of processing is lifted.

You have the right to receive the personal data concerning you that you have provided to us in a structured, commonly used and machine-readable format. You have the right to transmit this data to another controller, without hindrance from us, directly from us to another controller, where technically feasible. The exercise of the above right is without prejudice to your right to have your data deleted.

Any customer also has the right to object, free of charge and without any justification, to the processing of his/her personal data for direct marketing purposes.

In order to exercise all of the above-mentioned rights, you may at any time address a written request to our office in BUCURESTI, STR. MITROPOLITUL NIFON, NR. 3, ET. 1, SECTOR 4. You also have the right to apply to the courts.

Your data will not be transferred to another country.

By filling in the data in the message submission forms, you, the user/buyer, expressly declare and accept that your personal data will be included in the database of efk.com.ro and you expressly and unequivocally agree that all these personal data will be stored, used and processed for the purpose of executing the orders placed or responding to the messages and requests sent.

The buyer’s personal information may also be provided to the Public Prosecutor’s Office, the Police, the courts and other authorized state bodies, on the basis and within the limits of legal provisions and following expressly formulated requests.

You have the right to access, intervene, rectify and carry on the data you provide us, to limit the processing carried out by us and even to request the deletion of the data. Please note that interfering with the data you have provided to us may prevent the performance of the contract concluded between you and us. In this case, we will be exempt from liability. If you are dissatisfied, you have the possibility to address and lodge a complaint against us before the National Supervisory Authority for Personal Data Processing and before the competent courts.
